Andy Biggs threatens legal action against companies for private phone records request for January 6 investigation

Andy Biggs, along with ten of his colleagues, sent a letter to thirteen companies condemning Democrats’ attempt to obtain private phone records as part of their investigation into the events of January 6th.  According to Forbes, the letter was accidentally sent to the wrong CEO of Yahoo. It was sent to Marissa Mayer, who resigned as CEO more than four years ago. The current CEO is Guru Gowrappan. The letter was also sent to Amazon, AOL, Apple, AT&T, Facebook, Google, Microsoft, Snap, T-Mobile, Twitter, U.S. Cellular Corporation, and Verizon. The letter tells the companies that they will “pursue all legal remedies” if they release information.

In a press release, Biggs stated, “The January 6 Select Committee has neither statutory nor constitutional authority to secretly demand phone companies turn over their customers’ personal records. This power-hungry, smear-campaign of a committee knows this request is a blatant overreach of their congressional authority. Yet, they insist these companies make legally compromising decisions. If these phone companies give into this unconstitutional subpoena, they will forever set a precedent for the violation of all Americans’ privacy rights.”

“The January 6 Select Committee has neither statutory nor constitutional authority to secretly demand phone companies to turn over their customers’ personal records,” Biggs told FOX Business in a statement.

“This power-hungry, smear-campaign of a committee knows this request is a blatant overreach of their congressional authority,” he continued. “Yet, they insist these companies make legally compromising decisions. If these phone companies give into this unconstitutional subpoena, they will forever set a precedent for the violation of all Americans’ privacy rights.”

The same group of legislators joined Biggs last week, sending a letter to Minority Leader Kevin McCarthy asking for a reconsideration of a GOP Conference Rule change that would remove members who accept committee assignments or serve on a committee without a recommendation from the Republican Steering Committee or the Republican Leader. That letter was in response to the select committee investigating the January 6th attack on the Capitol. The group is trying to have Liz Cheney and Adam Kinzinger booted from the GOP Conference because they are helping with the January 6th investigation.

Other co-signers include Jim Banks, Matt Gaetz, Jody Hice, Scott Perry, Lauren Boebert, Louie Gohmert, Paul A. Gosar, D.D.S., Marjorie Taylor Greene, Madison Cawthorn, and Mo Brooks.
